Document Scanning for UK Law Firms

Law firms are among the most paper-intensive businesses in the UK. Every matter generates correspondence, contracts, court documents, attendance notes, and compliance records. Case File Scanning

The core of legal scanning is the case file — everything associated with a single matter. Effective case file scanning requires more than feeding paper through a scanner. Each document must be classified by type and filed to the correct matter folder with appropriate metadata.

  • Sort: Separate the file into document types — correspondence, attendance notes, drafts, final documents, financial records, ID verification

Court bundles are one of the highest-value scanning use cases in legal. Preparing a bundle from paper files is labour-intensive — photocopying, paginating, indexing, duplicating for each party. With digital case files, bundle preparation becomes a matter of selecting documents, ordering them, adding page numbers, and generating a PDF bundle with hyperlinked index.

For firms that receive paper bundles from other parties, scanning them into the matter folder immediately makes them searchable and accessible to the whole team. Matter Folder Structure in SharePoint

SharePoint is increasingly common as a legal DMS, particularly in smaller and mid-size firms. The key to making it work for legal is a consistent matter folder structure. Every matter folder should follow the same template:

  • 01 - Client & Matter Opening — engagement letter, client ID, conflict check, money laundering verification
  • 02 - Correspondence — incoming and outgoing letters, emails filed from Outlook
  • 03 - Attendance Notes — file notes from meetings, calls, and conferences
  • 04 - Drafts — working drafts of documents under negotiation
  • 05 - Final Documents — executed contracts, completed deeds, final versions
  • 06 - Court & Tribunal — court orders, witness statements, bundles, skeleton arguments
  • 07 - Financial — bills, time records, disbursements, client account ledger
  • 08 - Research — legal research, counsel's opinions, precedent documents

SRA Compliance

The Solicitors Regulation Authority requires firms to maintain proper records. For document scanning, the key SRA requirements are:

  • Client file retention: Minimum 6 years after matter closure for most practice areas. Longer for personal injury (date of knowledge), wills and probate (indefinite for original wills), and child-related matters
  • Confidentiality: Access to matter files must be restricted to the team working on that matter. Ethical walls (information barriers) must be enforced where conflicts exist
  • Data protection: Client data must be handled in accordance with UK GDPR. Digital systems must have appropriate security — encryption at rest and in transit, multi-factor authentication, audit logging
  • Accounts rules: SRA Accounts Rules require financial records to be kept for at least 6 years. Scanned financial records are acceptable provided they are legible and complete

Six-Year Retention and Beyond

The 6-year retention period is a minimum, not a maximum. Many firms retain files for longer as a matter of policy — 10 or 15 years is common. For specific practice areas:

  • Personal injury: Retain until at least 3 years after the claimant's date of knowledge (which may be years after the matter closes)
  • Conveyancing: Title documents should be retained for 15 years (limitation period for land disputes)
  • Wills: Original wills must be retained indefinitely; other probate documents for 12 years
  • Child-related matters: Retain until the child turns 21, plus a reasonable buffer
