Going Paperless in a Law Firm: A Practical UK Guide

The Case for Going Paperless in Legal

The average UK law firm spends 30–40% of its administrative overhead on document management — filing, retrieving, photocopying, posting. A fee earner billing at £150–300/hour who spends 30 minutes per day searching for documents is losing £75–150 in billable time daily. Across a 10-fee-earner firm: £375–750/day, over £90,000–180,000/year in lost billing capacity.

Beyond the economics: remote working is now standard in most practices. Paper files that can't leave the office are a barrier to flexible working and a competitive disadvantage in fee earner recruitment.

What the SRA Requires

The SRA doesn't prohibit going paperless — it requires that client information is handled securely and that records are retained appropriately. Key requirements:

  • Retention: Client files must be retained for at least 6 years after matter closure (some areas of practice longer)
  • Security: Client information must be protected from unauthorised access — digital systems require appropriate access controls
  • Confidentiality: Documents must not be accessible to staff working on conflicting matters
  • Destruction records: When files are destroyed, a destruction log must be maintained

A well-configured legal DMS satisfies all of these requirements more reliably than paper filing.

What to Keep as Originals

Not everything can be digitised and destroyed. Documents where the original has legal significance must be retained physically:

  • Signed deeds: Transfer deeds, mortgage deeds — originals required by Land Registry for registration
  • Original wills: Testator's original will must be kept
  • Some company documents: Wet-ink signed articles of association, share certificates
  • Court originals: Some court documents where the original is required for proceedings

For everything else — correspondence, attendance notes, draft documents, client identification, financial records — a scanned digital copy has the same legal standing as the paper original. The Law Society has confirmed this position.

The Right DMS Structure for Legal

Legal DMS structure must be matter-centric, not document-type-centric. The hierarchy: Client → Matter → Document. Every document in the firm links to a client and a matter. Searching by client name or matter number returns all related documents regardless of type.

Within each matter folder, a consistent sub-folder structure helps: Correspondence, Attendance Notes, Drafts, Final Documents, Financial, ID and Due Diligence. Apply this template to every matter from the start.

Metadata fields for legal documents: Matter Number, Client Name, Document Type, Date, Fee Earner, Confidentiality Level (for ethical wall purposes). These four fields make any document retrievable in seconds.

Scanning Incoming Correspondence

The most impactful immediate change: scan all incoming post the day it arrives. Assign the post room or receptionist to scan every incoming document to the correct matter folder before distributing or actioning. From that point, the physical copy can be recycled (unless it's a category requiring original retention).

Handling the Historical Backlog

Open matters should be digitised first — working files that fee earners need access to daily. Closed matters within retention period: prioritise by likelihood of reference (recent closures, contentious matters, high-value clients). Historic archive: consider whether the cost of digitising outweighs the benefit — some very old closed files may be cheaper to maintain in physical archive until they reach their destruction date.

Training Fee Earners

The most common reason legal DMS implementations fail: fee earners don't adopt the new system and continue working from paper or email attachments. This isn't a technology problem — it's a behaviour change problem.

Keys to fee earner adoption: Outlook integration that files emails to matters with one click (non-negotiable); fast, reliable search that returns documents quicker than filing cabinets; mobile access on phones and tablets for court and client visits; a visible champion among senior fee earners who uses the system visibly.
